We may collect anonymous usage information that does not identify an individual User ("Non-Personal Information") when Publishers, advertisers, and ad networks use the Kevel's ad serving platform. Kevel uses its cookies to serve relevant and targeted advertisements. A visitor receives a cookie from Kevel when they visit a website where one of our Publishers, Advertisers, and/or Networks has an ad call. We encode our cookies so that only we can interpret the information stored in them. You are free to decline our cookies if your browser permits, but doing so may result in seeing ads that are not relevant to you.
Throughout this policy, we use the term personal information to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been made anonymous so that it does not identify a specific user. We store and process your personal information on our computers in the US, and we protect it by maintaining physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities. All credit card information is encrypted with 128-bit SSL encryption before it is transmitted across the network.
We retain the anonymous data that we collect (e.g., which ads you have seen) for a maximum of 12 months from the date of collection after which the information is destroyed. In compliance with the GDPR, for European Union residents we collect data only for those who have consented to be tracked.
We may in some cases disclose personal information to our subsidiaries and affiliates and to any contractors, service providers and other third parties who need to know such information to support our permitted uses of personal information.
We may share aggregated non-personally identifiable information about you with Publishers or Advertisers, such as the number of users who visit a Publisher site or the number of users who clicked on a particular advertisement. This information does not identify you individually. Further, we encourage you to review the privacy policies of the Publishers that you visit. You should contact Publishers directly and review their privacy policies should you have questions concerning their use of your information such as, for example, communications you may or may not wish to receive.
We intend to protect your privacy to the fullest extent possible as described in this policy while also fulfilling our responsibility to uphold all applicable laws and regulations. Due to potential legal requirements and other possible circumstances, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed or accessed in ways not otherwise described in this policy. We may be compelled under law to disclose information to governments or third parties under certain circumstances or third parties may unlawfully intercept or access transmissions or private communications. Further, we can, and you hereby authorize us to, disclose any information to law enforcement or other government officials that we, in our sole discretion, believe necessary or appropriate in compliance with the law and national security or law enforcement requirements.
In the event that all or part of Kevel is acquired by or merged with a third party entity, you agree that we may transfer or assign the information we have collected from you as part of such merger, acquisition, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.
If you are a resident of the European Union, Switzerland, or the United Kingdom, we may be transferring your Personal Information to the United States under the terms of our certification with the U.S. Department of Commerce under the EU- U.S. or the Swiss-U.S. Privacy Shield Frameworks.
ii. In compliance with the Privacy Shield Principles, Kevel commits to resolve complaints about our collection or use of your personal information. EU or Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Kevel at: [email protected]
iii. Kevel has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact JAMS or visit https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint. The services of JAMS are provided at no cost to you.
iv. If you are still not satisfied, you may have the right, under certain conditions to invoke binding arbitration. You can find more information on your enforcement rights at https://www.privacyshield.gov/
v. This Policy covers Kevel only, and Kevel does not at this time have affiliated entities that are covered by this Policy.
vi. You may also send us an email at [email protected] to request the right to view any of your Personal Information that we store and use, and to correct, amend or delete any such Personal Information that is inaccurate, and we will permit you to do so unless the burden or expense of providing access would be disproportionate to the risks to your privacy, or when the rights of others would be violated or when the information is confidential commercial information or when certain other narrow exceptions apply.
vii. If you do not wish to have your Personal Information used by us to promote our own or third parties’ products or services, or if you do not want us to share your Personal Information with third parties (including for promotional or direct marketing purposes, such as delivering advertisements according to our advertisers’ target-audience preferences) or if you do not wish us to use your Personal Information for a disclosed purpose that is materially different than the purpose for which the Personal Information was originally collected or subsequently authorized by you, you can opt-out by sending us an email stating your request to [email protected] If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to disclosure to a third party that is acting on our behalf and under our instructions in support of our permitted uses of your Personal Information.
viii. If we disclose your Personal Information to any third party that will have the right to determine its purposes for processing your Personal Information and the means it will use to process your Personal Information (rather than just providing requested assistance to us in support of our permitted uses of your Personal Information), we will notify you and we will enter into a contract with that third party that provides that your Personal Information may be processed only for limited and specified purposes consistent with the consent that you have provided to us, and that the third party must provide the same level of protection for your Personal Information that we are obligated to provide under this Policy while it is processing your Personal Information. Please note Kevel does not currently engage in onward transfers of Personal Information to third parties that will have the right to determine its purposes for processing your Personal Information and the means it will use to process your Personal Information.
ix. In the context of an onward transfer Kevel has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. Kevel shall remain liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage.
We have implemented reasonable security measures on the Site to help protect against the loss, misuse and alteration of the personal information under our control. Additionally, Kevel takes reasonable steps to ensure that our third party business partners, including our hosting partners, provide sufficient protection for personal information.
